At the center of this clarification is an incident that occurred over a decade ago and received considerable public attention at the time. Media reports at the time focused almost exclusively on a first-instance conviction — without reflecting the subsequent rulings of the Federal Constitutional Court of Germany, which overturned decisions by regional and higher regional courts in three separate judgments, most recently in 2021. In all instances, the Court found violations of fundamental rights, particularly personal freedoms.

No adequate or proportionate media coverage of these constitutional rulings ever followed. As a result, a distorted and incomplete public perception remains, one that does not reflect the actual legal facts.
